Note for customers of the site and services of EOLE VOYAGES

 

EOLE VOYAGES and its client(s) undertake to respect them.

 

The company EOLE VOYAGES offers its customers a set of "personalized" services in France but also abroad. The company EOLE VOYAGES has no obligation to reproduce an identical service (organization, prices, etc.)

EOLE VOYAGES complies with articles R.211-3 to R.211-12 of the Tourism Code.

 

You acknowledge being at least 18 years old, not being under guardianship.

You acknowledge that all the information you provide to EOLE VOYAGES is accurate and true.

By placing an order for all or part of the services and services offered by EOLE VOYAGES, you agree to accept these conditions.

You acknowledge, as well as any written and signed contract, that these general conditions are binding. If you refuse them, you agree not to use the services of EOLE VOYAGES.

EOLE VOYAGES reserves the right to modify these general conditions of use following changes in legislation or commercial policy.

All customers and partners undertake to read them regularly and inform themselves of their developments before each new order is taken.

In accordance with article 1137 of the civil code, EOLE VOYAGES is bound by an obligation of means and not of result. EOLE VOYAGES cannot be held responsible for a late arrival due to traffic jams, accidents or any other event beyond its control. In addition, EOLE VOYAGES must respect the highway code in force. The driver cannot be asked to overspeed, to take lanes which would be prohibited to him except at the request of the police forces present.

 

Any damage caused by the customer will be invoiced to him as well as an indemnity of €1000 per day of immobilization of the vehicle in addition to the repair costs.

The company EOLE VOYAGES declines all responsibility for any effects forgotten in the vehicles. The costs of repatriation of the said effects are the responsibility of the customer.

 

Prices

The rates offered by EOLE VOYAGES on its website, its commercial documents, its quotes and invoices and all other documents come directly from EOLE VOYAGES include all taxes (TTC) and in euros (€). They are listed for information only. Only the price quotes are valid and contractual.

The quotes established by EOLE VOYAGES are established on the mileage basis provided by the mappy.fr website.

Rates include

The VAT in force at the time of the service. This VAT is likely to change according to French regulations (as of January 1, 2023, it is 10% for transfers or making available). The driver's service, fuel costs and insurance for the persons transported.

Toll and parking fees, driver's food costs for all trips in the time slots between 11:30 a.m. and 2:00 p.m. and 7:00 p.m. and 9:00 p.m. in accordance with French law. Accommodation costs (hotel, breakfast, meals) for travel in the provinces and abroad.

 

Prices do not include

Exceedances of time or kilometer which were not foreseen during the confirmation of the estimate by the customer. They will be added to the final invoice. Any hour started is due.

The first half-hour of waiting in relation to the pick-up time is offered beyond this ½ hour the wait is counted on an hourly basis ranging from 70€ to 110€ per hour depending on the vehicle reserved.

 

As part of the establishment of an estimate, the latter is valid for a period of 30 calendar days from the date of establishment of the said estimate.

 

Reservation(s) – obligation(s)

Following your request, you will receive a quote from us. As soon as you have validated it (by electronic confirmation or by return mail duly signed), it will be considered as confirmed and these conditions as accepted.

A confirmation of the service will then be sent to you.

The firm reservation will be effective upon receipt of the sponsor's credit card information (name of cardholder; card number; expiry date; security symbol on the back of the card)

For customers on account with EOLE VOYAGES, a guarantee check for an amount equal to or greater than the trip ordered must be in the possession of EOLE VOYAGES in order to confirm the service.

Depending on the requests, a deposit ranging from 30 to 100% of the amount of the order may be requested before the start of the service.

 

The company EOLE VOYAGES informs its customers that, in accordance with article L.121-20-4 of the consumer code, there is no right of withdrawal for the provision of accommodation, transport, catering services. and leisure.

 

EOLE VOYAGES reserves the right to cancel a service in the event of force majeure. It will make every effort to best satisfy its client without however being able to guarantee the same pricing or the same service.

 

The customer agrees to provide, at the time of booking, information, when possible, for the smooth running of the service.

The date, time and place of the end of the mission. The number of passengers, the number of pieces of luggage and their sizes and weights. The age of any children in order to provide the appropriate seat if the customer does not provide it. The contact details of a responsible person who can be reached during the provision of child transport.

 

The validation of the quote whether by post, email or text message implies full acceptance of these general conditions of sale.

 

Payment is made by bank transfer, payment by “direct” or “distance selling” bank card or by cash within the limits of French regulations.

 

The customer agrees to be in good standing vis-à-vis the administrations concerned, whether from an administrative or health point of view, to transport any product or object that is illegal under the law. The company EOLE VOYAGES does not disengage in full in the event of non-compliance with these rules and can therefore cancel all services without compensation for the customer who must, however, pay the balance of the invoice.

 

EOLE VOYAGES uses intermediaries and duly selected subcontractors. In the event of disputes, EOLE VOYAGES cannot be confused with them. They retain full responsibility vis-à-vis the customers of the company EOLE VOYAGES

 

The start and end times of the mission, whether it is a transfer, a half-day or several-day availability, are given as an indication. The driver can cancel the mission in case of danger, technical problem or take a regulatory or necessary break. The company EOLE VOYAGES could not be held responsible for delays due to delays for external events (breakdown, accident, deviation or any other problem).

 

Unless otherwise provided for by the highway code, the customer agrees by signing the service contract between him and the company EOLE VOYAGES to use the seat belts as well as to all the people involved in the service.

The customer agrees to provide luggage that allows the stacking of the latter and the integrity of what they contain. The company EOLE VOYAGES cannot be held responsible for the deterioration of what they contain.

 

The company EOLE VOYAGES and/or the driver who will be delegated for a service may refuse the transport of any person, any object or bag that may generate damage, danger or not comply with the regulations and this without any compensation for the customer who will nevertheless have to pay the possible balance of the invoice.

 

The company EOLE VOYAGES makes every effort to provide its services within a framework of comfort, regulation and safety (number of people on board, age, volume of luggage, wheelchair-child seat) for this reason the company EOLE VOYAGES does not can be held responsible if all the passengers and/or baggage do not correspond to the initial request. EOLE VOYAGES may then either call on a company outside of another service provider (at the customer's expense) or cancel the service without any compensation.

 

Payment

The company EOLE VOYAGES does not keep any bank details of its customers after payment by credit card. The company EOLE VOYAGES sends, as soon as the payment is made, the receipt by post or electronic mail.

 

Cancelation

In the event of cancellation by the client of EOLE VOYAGES.

No charge for cancellations 72 hours before the service (except for services requiring exceptional costs or long-term services)

For cancellations made between 48 and 72 hours, the customer will be charged 50% of the service.

The entire service will be invoiced for any cancellation within 24 hours before the start of the service.

 

Complaints

Any complaint, cancellation, poor performance of the contract must be reported to the company EOLE VOYAGES as soon as possible by telephone and email then by registered letter with acknowledgment of receipt within a maximum of 30 days after the end date of the mission. After this period, no complaint can be taken into account.

If an amicable solution is not found, the 2 parties can turn to the competent court.

 

Assurance

 

The company EOLE VOYAGES is insured by the company "GAN", insurance contract N° 311354952000, this contract covers the risks which may be linked to its activity in accordance with the laws in force. The insurance of the goods transported by the company EOLE VOYAGES is entirely the responsibility of the client. The company EOLE VOYAGES cannot be held responsible for any theft, deterioration or destruction of the objects transported.

The company EOLE VOYAGES advises each of its customers to take out a multi-risk guarantee covering, among other things, the costs of cancellation, repatriation, illness or other.

The company EOLE VOYAGES can offer insurance on the goods transported at the express request of the customer, who will bear the additional cost incurred (the subscription deadlines depend on the insurance and not on the company EOLE VOYAGES).

 

CNIL

In accordance with the Data Protection Act of January 6, 1978 amended by the Act of August 6, 2004 relating to the protection of individuals with regard to the processing of personal data, any customer has, at any time, a right access, modification, rectification or deletion of data concerning him. For this, the customer may consult and modify his data as follows:

Copyright

In accordance with law 57-298 of March 11, 1957 and its subsequent modifications, all the content of the website, brochures or any other medium produced by the company EOLE VOYAGES is its own. Any reproduction, even partial, is prohibited without prior agreement with the manager of EOLE VOYAGES. Any breach will result in prosecution before the competent courts.
